Definitions
Reserving or participating in any travel services offered by OpenUp Swiss Travel Experience SA (hereinafter "The Company") constitutes a contractual agreement between the participant (“you") and The Company and is an acknowledgment that you have read, understand, and agree to be bound by these Terms & Conditions. You must be at least 18 years of age to make a reservation. In all cases, the person making the reservation represents and warrants that all participants have consented to, accepted, and agreed to be bound by these Terms.
The Company reserves the right to update or amend these Terms at any time prior to you making a reservation. The Terms listed online when completing a reservation are those that control.
Any payment made to The Company shall be deemed to constitute full acceptance of these Terms.
Website
The main purpose of our Website is to provide information and booking facilities for travel destinations and associated products and services from time to time. We may update our Website from time to time and may change the content at any time. Any of the material on our Website may be out of date at any given time, and we are under no obligation to update that material. We do not guarantee that our Website will be available 24/7, or that any content on it will be free from errors or omissions. We reserve the right to withdraw or amend our Website or parts of it without notice.
Rates and Terms of Payment
The Tour price per person has stated in the price list in Swiss francs. All prices are quoted including VAT. Prices are subject to change. The Tour Price is due at the time of booking.
Cancellation Policy
All cancellation fees held by OpenUp Swiss Travel Experience SA are only intended to cover our direct cost of amending and/or canceling your reservation. By accessing, browsing, using, and/or completing a reservation through our (mobile) website you acknowledge and agree to have read, understood, and agreed to be legally bound to the cancellation policy as set out below. No contract between the customer and OpenUp Swiss Travel Experience SA shall comes into existence until OpenUp Swiss Travel Experience SA receives full payment and issues a confirmation invoice. The customer making the booking accepts these conditions on behalf of all members of their travel party and is responsible for payment due from the party in its entirety.
All communications relating to these terms and conditions (in particular any requests to cancel or amend your tour arrangements) must be from the lead traveler of each reservation and must be delivered in writing via the customer contact form. Once delivered the amendment and/or cancellation needs to be confirmed by OpenUp Swiss Travel Experience SA before further action can be taken. If reimbursement is in order, then it shall be made in accordance with all procedures and processed as quickly as possible, and the stipulated amount will be transferred to the same credit card that was used upon booking. Please note that we can not be responsible for delays of the delivery of the reimbursement to your account once it has been processed on our end. For tours purchased through another vendor please reach out to the vendor directly with your refund and/or cancellation request. The cancellation policy applies to the original booking departure date the tour has been booked for.
Cancellation fees&charges
Changing the number of people in a booking to a smaller number is considered cancellation for the change in the number of participants. Such cancellations are subject to cancellation fees as per the below.
As we start to incur costs from the time the contract is confirmed we will apply cancellation charges as shown below from the time when written notification of the cancellation is received:
For all bookings of day tours operated by OpenUp Swiss Travel Experience SA a minimum of 24 hours' notice of cancellation or amendment prior to your scheduled tour departure is required for a full refund. If a cancellation is made with less than 24 hours' notice prior to departure no refund is given.
For all bookings of Multi-day tours operated by OpenUp Swiss Travel Experience SA a minimum of 21 days' notice of cancellation or amendment prior to your scheduled tour departure is required for a full refund.
For all cancellations of Multi-day tours operated by OpenUp Swiss Travel Experience SA less than 21 days’ notice before trip departure you will be refunded 50% of the total tour price. 50% is non-refundable, as this represents our direct cost of booking and preparing your tour.
If a cancellation of Multi-day tours is made with less than 10 days' notice prior to departure no refund is given.
All cancellations must be delivered in writing via E-mail: booking1@openup-swiss.ch and sent by the lead traveler.
Please note that this only applies to tours operated by OpenUp Swiss Travel Experience SA.
Tours operated by trusted partners are subject to the operators‘ cancellation policy.
Alteration of the Itinerary
There is no extra service charge for any changes made before the tour starts. However, you will be responsible for any possible additional costs incurred due to reservation changes.
After the tour starts, any extra expenses caused by clients’ own changes will be added. Any unused service is non-refundable nor exchangeable.
Passports and Visa
Please make sure that your passport is valid (with at least 6 months validity) before you start your trip.
You are advised to verify and defer to the visa policy of the countries you are going to visit.
Additional Information
It’s highly recommended to purchase travel insurance before your trip in order to minimize any unexpected losses and damages.
Please be sure to check carefully your flight tickets so as to fully understand the rules and policies of the airline companies.
When checking in at the hotels, guests are expected to provide a valid credit card authorization to guarantee any possible personal consumption (e.g. laundry) during their stay.
Changes to Itineraries
OpenUp Swiss Travel Experience SA reserves the right to cancel, delay, or reschedule any tour prior to departure, and, so long as this is not due to any causes beyond our control (as stated in the Limits on Responsibility section) the passenger shall be entitled to a full refund of all monies paid to that point if he/she so desires, less any non-refundable deposits or uncollectible expenses incurred. If we do change the itinerary, and you are already booked for that particular trip, we will notify you of the changes. If you are not pleased with the changes you may receive a full refund provided you request a refund 3 business days after receiving a notice of change to your trip itinerary from OpenUp Swiss Travel Experience SA.
Governing Law & Jurisdiction
The Swiss courts will have exclusive jurisdiction over any claim arising from or related to, a visit to our Website although we retain the right to bring proceedings against you for breach of these Terms in your country of residence or any other relevant country.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Switzerland.
Complaints
No matter when and where you are not satisfied with our service, please let us know immediately via email, phone, or through your local guide. In this case, we can solve the problem as soon as we can and avoid it in the future. Our team aims to assure you of an exhilarating and rewarding experience with us.
